A 10-year-old girl was gang-raped and murdered by her neighbours in north Delhi, PTI reported. Her body was reportedly found in an abandoned plot with her head crushed on Friday morning, police said.

Two people have been arrested in connection with the case, according to what they have indicated. The woman was allegedly gang raped and then murdered by her neighbors.

According to the report, the police received a PCR call around 12.30 am on Friday from the victim’s father who reported her missing, said deputy commissioner of police (outer north) Ravi Kumar Singh.

The victim’s father informed police that he realized his daughter was missing around 9:45 p.m. They started looking for her and called the police when she did not return home, Singh said.

According to PTI, soon after the call, the police found the girl’s body in a nearby abandoned plot with her head crushed, Singh said.

Locals saw the victim’s neighbor Rahul (20) carrying the girl towards the plot, the DCP said.

Based on the father’s complaint, Rahul and Devdutt (30) have been arrested and are being questioned, DCP said.

According to the police, the two accused allegedly lured the girl on the pretext of taking her to a nearby restaurant and committed the crime.

A case was registered against the accused under sections 363 (punishment for kidnapping), 302 (murder) and 376D (ganuva) of the Indian Penal Code and the Protection of Children from Sexual Offenses (POCSO) Act. Further investigation is underway, the DCP said.

Court rejects Thane doctor’s bail plea in rape case

A court has rejected the bail plea of a Thane doctor arrested for allegedly raping a woman after promising to marry her. The 32-year-old doctor from Thane was denied bail as the court felt that he might tamper with evidence as investigation into the case is ongoing, PTI reported.

The court, according to the PTI report, stated: “Tampering of evidence is possible in case bail is granted while investigation is pending.”

Additional Sessions Judge Premal S Vithalani, while denying bail to the Thane-based doctor, said, “Hence, in my view, looking at the stage of investigation, gravity of the offence and facts of the case, no case has been made out for grant of bail.”

He reportedly issued an order in the case on June 11 and a copy of it was made available on Tuesday.

The judge, in his order denying bail to the Thane doctor, said the verdict on the bail plea should be given keeping in mind the facts and circumstances of the case. Justice Vithalani said: “Each bail application must be decided considering the facts and circumstances of the particular case. There can be no straitjacket formula for granting or rejecting bail applications.”

The prosecution reportedly said the Thane-based doctor and the 27-year-old woman became friends in 2017 and he proposed to her in 2020.

The PTI report added that the woman approached the police earlier this year, following which an FIR was registered against her for rape and criminal intimidation. The Thane-based doctor, the report said, was arrested on May 7 after the court rejected her plea for anticipatory bail on April 24.

According to the PTI report, the protection had challenged the Thane doctor’s bail plea alleging that he had exploited the woman with false promises of marriage and threatened her into having sexual relations.

The court considered the evidence, according to the PTI report, which included mobile phone records and an audio recording provided by the informant’s lawyer. The court said: “Looking at the facts of the case, it has to be seen whether the accused deserves bail. There is no doubt that there was consent of the informant for physical relations. Many photographs showing intimacy have been placed in the record of counsel of the accused.”

However, it is alleged that due to the accused’s false promise of marriage and threats to make images and videos of sexual activity viral, the informant gave his consent, according to the court, adding that “definitely, such consent cannot be considered consent valid under the law.”
