Taking serious note of the assault on litigants in the district court, the Allahabad High Court issued criminal contempt notice to ten lawyers and also restrained them from entering the district court premises. The high court notification came after the district judge submitted the case report.
On April 30, the high court restrained two lawyers from entering the district court premises for their alleged involvement in the same incident. On April 29, some lawyers entered the high court located on the district court premises and allegedly beat up a litigant. Passing its order on Monday, a division bench comprising Justice Ashwani Kumar Mishra and Justice Mohd Azhar Husain Idrisi observed: “The incident in this case needs to be considered with utmost seriousness.
This court cannot allow judicial proceedings to be obstructed so that litigants are brutally beaten in the courtroom and the president has to flee to his chambers for his safety.” “This type of aggressive and violent behavior in court will cause a virtual collapse of the system. This court cannot be a silent spectator in the face of events of this type. “Unscrupulous persons must be sent a clear and unambiguous message that incidents of this kind will not be tolerated and must be dealt with sternly,” the court said.
He also asked Police Commissioner Prayagraj to ensure that adequate police force is available under the direction of the district judge to enable smooth functioning of the court. The high court also directed the commissioner of police to authorize a responsible officer, not below the rank of deputy commissioner of police, to specify the criminal records of all persons against whom notices were issued in the present contempt matter. The status of the investigation or the steps taken in this regard must also be specifically disclosed, the court stated in its order.
