The AAP government in Delhi is likely to seek permission from the Supreme Court to process the file for appointment of interim members of the city’s energy regulator DERC, official sources said on Saturday.
The Delhi Electricity Regulatory Commission (DERC) is a three-member body, including a chairman. The seats of two members have been vacant since last year.
A committee formed by the Supreme Court shortlisted the caretaker members, but their appointments were delayed because the Model Code of Conduct was in force for the Lok Sabha elections and due to the arrest of Delhi Chief Minister Arvind Kejriwal in March, they said. .
The file for appointment of provisional members has to be sent by the chief minister for the approval of the lieutenant governor of Delhi.
As Kejriwal is in jail, the file is pending and the Delhi government wants to seek the court’s permission for the Power Minister to directly forward it for approval to the lieutenant governor, sources said.
In August last year, the Supreme Court appointed retired Justice Jayant Nath as acting DERC president after the AAP government and the Delhi lieutenant governor failed to reach a consensus on a candidate for the post.
Following directions from the Supreme Court, a selection committee comprising current acting president Nath, Electricity Appellate Tribunal president retired judge Ramesh Ranganathan, and retired judge Asha Menon was formed in November last year to select to the two provisional members.
