The troubles of Delhi Chief Minister Arvind Kejriwal’s close aide Bibhav Kumar, accused in the alleged assault case of Aam Aadmi Party (AAP) Rajya Sabha MP Swati Maliwal, have increased further. Delhi Police has added another section of the IPC for “causing disappearance of evidence and giving false information” in the FIR registered against Bibhav Kumar. Bibhav Kumar was arrested on May 18 and is currently lodged in Tihar Jail.
Giving information about this on Monday, a Delhi Police official said that Bibhav Kumar is accused of assaulting Swati Maliwal at the Chief Minister’s official residence on May 13. The official said that Section 201 (causing disappearance of evidence of crime or giving false information to protect the offender) of the Indian Penal Code (IPC) has been added in the case. He said that Section 201 provides for imprisonment equal to one-sixth of the punishment given for the biggest crime in the crime.
Let us tell you that an FIR was registered against Bibhav Kumar on May 16 under several relevant sections of the IPC, including attempt to commit culpable homicide not amounting to murder. Former Delhi Commission for Women chairperson Swati Maliwal had alleged that when she went to meet CM Kejriwal, Bibhav Kumar attacked her with full force, slapped and kicked her.
Delhi Police had taken Bibhav to Mumbai twice
According to a senior police officer, Bibhav Kumar’s mobile phone was found formatted when he was arrested from Kejriwal’s residence on May 18. He was in Mumbai before returning to Delhi. The police took Bibhav Kumar to Mumbai twice. The officer said that he is suspected to have formatted his mobile phone in Mumbai itself, but he did not reveal where he formatted it or with whom he shared the data. He said that Bibhav Kumar did not cooperate in the investigation during police custody.
Another police officer said three CCTV DVRs were collected from Kejriwal’s residence – two from cameras installed at the entry gate and one from outside the drawing room. The DVRs were sent to the Forensic Science Lab as it was suspected that they had been tampered with. The report was awaited, he said.
